Auto Gearbox failure at 22k

Hi

I bought my 2018 X1 M Sport in 2019 from a main dealer, had it serviced by local main dealer at the correct time. It’s not my main driver so only does minimal mileage (now 23k). Just after Xmas this year the dreaded ‘drive train error’ message appeared & although this disappeared occasionally the car was very jerky while accelerating.  
As the car was out of warranty I took it to a BM specialist who diagnosed the fault a valve issue, £2900 later it’s good as new but my question is should BMW pay for the replacement part ?  
I started a dialogue with the suppling dealer just over 2 months ago who have been sympathetic & say they are asking BMW for ‘financial support’ but so far nothing has been offered.

Any suggestions as to what my next move should be please ?

Afternoon Martin

A tough one to help with. When the fault first appeared did you contact the Dealer and note the mileage? Hopefully you did which can strengthen your case with them and BMW what was their suggested action? Also check any other Forums eor any other reports?

Hi my 2018 MSport gearbox started jolting at 27000 and was repaired under warranty they said the start stop may have caused the damage I think there is a problem with this gearbox and BMW need look into it

Hmmm The Dealer is digging a hole with his mouth that may prove difficult to get out of if the fault returns, Surely when BMW designed the car they would have worked with the gearbox Manufacturer and let them know the cars power/torque output and of course any systems such as stop start ???? 

As I said in my earlier reply gather as much evidence on any other failures as you can.
